Penalties for felony domestic violence offenses are normally determined by the class of felony for the underlying offense. In non-dangerous, non-repetitive offenses, probation is available at the discretion of the court.The chart below shows the sentencing ranges available to the court for these felonies.

Dangerous Nature Felony Offenses

Many domestic violence felony offenses are charged as "dangerous nature" offenses. Arizona statute define "dangerous offense" as an offense involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the intentional or knowing infliction of serious physical injury on another person. Punishment differs in two distinct ways for dangerous nature offenses. First, probation is not available in dangerous nature offenses. Secondly, prison terms are substantially increased. The chart below details the prison ranges for a first time conviction on dangerous nature offense.

Repetitive Dangerous Nature Felony Offenses

The repetitive dangerous nature table only applies in cases where a person has one or more prior dangerous nature convictions. If a person commits a dangerous nature offense with a non-dangerous nature prior, the prosecutor may elect to sentence the matter as a first time dangerous nature offense, or as a second time non-dangerous nature offense.
